    Marriages With Foreign Nationals) Rules, 1965

    PAKISTAN WATER AND POWER DEVELOPMENT AUTHORITY

    No. 6(27) R&R/5279 6th October, 1965.

    In exercise of the powers confer ed by Section 18 of the West Pakistan Act No. XXXI of 1958, as amended, the Pakistan Water and Power Development Authority is pleased to make the following Rules namely:—

    THE PAKISTAN WAPDA EMPLOYEES (RESTRICTION ON MARRIAGES WITH FOREIGN NATIONALS) RULES, 1965

    1. Short Title, Commencement and Application

      1. These Rules may be called the Pakistan Wapda Employees (Restrictions on Marriages with Foreign Nationals) Rules, 1965.

      2. They shall come into force at once.

      3. They shall apply to all Wapda employees other than persons employed on contract basis.

    2. Definitions

      In these Rules, unless the context otherwise requires, the following expressionsjshall have the meanings hereby respectively assigned to them, that is to say:—

      1. "Foreign National" means a person who is not a national of Pakistan:.

      2. "Authority" means the Pakistan Water and Power Development Authority;

      3. '"Employee" means a person who has been directly recruited by the Authority;

      4. "Marriage" means the matrimonial relationship entered into in accordance with any law for the time being in force or in accordance with any religions, rites or
        ceremonies, and its grammatical and cognate expressions shall be construed accordingly; and

      5. "Misconduct" means any act or omission prejudicial to good order or service discipline or unbecoming an officer and a gentleman.

    3. Prohibition on Marriages with Foreign Nationals

      Save as provided in rule 4, a Wapda employee who marries or promises to marry a foreign national shall "be guilty of misconduct, and render himself liable to any of the major p nalties under the Wapda Employees (E&D) Rules applicable to him.

    4. Permission to Marry a Citizen of India

      1. A Wapda employee may, with the prior permission of the Authority, marry or promise to marry a Muslim citizen of India.
        Provided that in exceptional cases, a Wapda employee may, with the permission of the Authority, marry a foreign national other than a citizen of India.

      2. The grant of permission under sub-rule (1) shall be at the sole discretion of the Authority and shall be subject to such conditions, if any, as may be specified by the Authority.
